Terms of Sale
These Terms of Sale govern the purchase and redemption of the Chestnut Street Circuit pass, offered jointly by Body Temp Yoga and Vital Ice SF in the Marina District of San Francisco, California. Last updated July 31, 2026. By purchasing a pass you agree to all 14 sections below.
1. Program overview
Chestnut Street Circuit is a limited seasonal program pairing hot yoga classes at Body Temp Yoga with cold plunge, contrast, and sauna recovery sessions at Vital Ice SF, located roughly 25 steps apart on Chestnut Street. A pass is a prepaid bundle of visits to both businesses. Each business independently operates its own facility, schedule, staffing, and house rules. Neither business is the agent, partner, or guarantor of the other, and each is responsible only for the services it provides.

Prices are in U.S. dollars and exclude any applicable taxes. Classes and sessions are not interchangeable between businesses: a Body Temp class may not be redeemed as a Vital Ice session or vice versa. Vital Ice sessions are community sessions and do not include private bookings, add-on services, or retail products.
3. Validity and expiration
All passes are valid for redemption from September 1, 2026 through November 30, 2026. Every included class and session must be used on or before November 30, 2026. Unused classes and sessions expire on that date and have no refund value, no cash value, no credit value, and cannot be extended, rolled over, banked, or reinstated for any reason, including illness, travel, injury, or facility scheduling. Passes are not gift cards or gift certificates within the meaning of California Civil Code sections 1749.45 et seq.
4. No refunds
All sales are final. Passes are non-refundable in whole or in part, including partially used passes and passes never used at all. This refund policy is posted at the point of sale in accordance with California Civil Code section 1723. The only exceptions are the cancellation rights required by California law and described in section 11, and any cancellation a business grants in its sole discretion. Filing a chargeback in place of a permitted cancellation may result in immediate revocation of the pass.
5. Non-transferability
A pass is personal to the purchaser and may not be sold, resold, gifted, shared, split between people, assigned, auctioned, or transferred. Classes and sessions may be redeemed only by the individual named at checkout, who may be asked for identification. A single individual may purchase multiple passes for their own use. Any pass presented by someone other than the purchaser may be voided without refund.
6. Assumption of risk — hot yoga
Body Temp Yoga classes are conducted in rooms heated to approximately 95–105°F (35–41°C), often at elevated humidity. Exercise in that environment carries inherent risks including heat exhaustion, heat stroke, dehydration, electrolyte imbalance, dizziness, fainting, nausea, overstretching due to heat-loosened tissue, muscle and ligament strain, slips on wet surfaces, cardiac events, and in rare cases permanent injury or death. You agree to hydrate before and after class, to rest whenever you feel unwell, and to leave the room at any time you choose. You knowingly and voluntarily assume all of these risks.
7. Assumption of risk — cold plunge, contrast, and sauna
Vital Ice SF sessions involve immersion in water held at approximately 38–50°F (3–10°C), sauna and infrared heat of roughly 150–200°F (65–93°C), and contrast cycling between the two. Inherent risks include cold shock response, involuntary gasping and hyperventilation, sudden spikes in heart rate and blood pressure, cardiac arrhythmia or arrest, vasovagal fainting, loss of motor control, hypothermia, non-freezing cold injury, afterdrop, nerve pain, burns, dehydration, heat illness, slips and falls on wet surfaces, and in rare cases permanent injury or death.
Never plunge alone, never submerge your head, never hold your breath underwater, and never combine cold immersion or sauna use with alcohol, cannabis, stimulants, or sedatives. Exit immediately if you experience chest pain, numbness, confusion, or uncontrollable shivering, and follow all staff instructions on time limits.
You knowingly and voluntarily assume all of these risks as a condition of participation.
8. Health representations
You represent that you are at least 18 years old, that you are in good physical health, and that you have consulted a physician about heat and cold exposure if you have any condition that could be affected by it. You agree to disclose relevant conditions to staff and to follow all posted and verbal safety instructions.
Do not participate without written physician clearance if you are pregnant or may be pregnant, or if you have cardiovascular disease, a history of heart attack or stroke, uncontrolled high or low blood pressure, arrhythmia, a pacemaker or implanted device, a seizure disorder, diabetes with neuropathy, asthma or other respiratory disease, Raynaud’s phenomenon, cold urticaria, cryoglobulinemia, sickle cell trait or disease, an open wound or active infection, an eating disorder, or any other contraindicated condition. You agree to notify staff before participating if your health status changes.
9. Release of liability
To the fullest extent permitted by California law, you release, waive, discharge, and covenant not to sue Body Temp Yoga, Vital Ice SF, and their respective owners, officers, members, employees, instructors, contractors, landlords, insurers, and agents (the “Released Parties”) from any and all claims, demands, damages, losses, causes of action, and liability of every kind, known or unknown, arising out of or related to your participation in classes or sessions or your presence at or use of either facility or its equipment, whether caused by the ordinary negligence of the Released Parties or otherwise. You agree to indemnify and hold the Released Parties harmless from any claim brought by you or on your behalf arising from your participation.
Consistent with California Civil Code section 1668, this release does not apply to and does not attempt to limit liability for gross negligence, recklessness, willful or intentional misconduct, fraud, or violation of law by the Released Parties. Nothing in these terms waives any right that cannot lawfully be waived.
10. Waiver of California Civil Code section 1542
You expressly waive the protections of California Civil Code section 1542, which reads:
“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
Understanding that provision, you release the Released Parties from claims you do not know or suspect to exist at the time of purchase, to the extent those claims arise from your participation and are lawfully releasable under section 9 above.
11. California consumer disclosures
- Three-day right to cancel. Under California’s Health Studio Services Contract Law (Civil Code section 1812.80 et seq.), you may cancel this purchase without penalty by delivering written notice to either business before midnight of the third business day after the date of purchase. A full refund will be issued to the original payment method.
- Cancellation for death, disability, or relocation. If you die, become physically disabled such that you cannot use the services, or relocate more than 25 miles from both facilities, you or your estate may cancel and receive a pro-rata refund for unused sessions as provided by California law.
- Consumer complaints (Civil Code section 1789.3). Contact the Complaint Assistance Unit of the Division of Consumer Services, California Department of Consumer Affairs, 1625 North Market Blvd., Suite N-112, Sacramento, CA 95834, or (800) 952-5210.
- Accessibility. Both businesses intend to comply with the Unruh Civil Rights Act and the Americans with Disabilities Act. Contact either location in advance to arrange accommodations.
- Proposition 65. Facilities may post Proposition 65 warnings where required. Review any posted notices on site before participating.
12. Automatic Renewal Law compliance
Every pass is a one-time purchase. There is no subscription, no recurring charge, no automatic renewal, and no continuous service offer within the meaning of California’s Automatic Renewal Law (Business and Professions Code section 17600 et seq.). No payment method is stored for future billing, and you will never be charged again unless you affirmatively buy another pass. When your pass is exhausted or expires, nothing renews and nothing is billed.
13. Privacy and payments
Payments are processed by Stripe; card details are transmitted directly to Stripe and are never stored on this site. We collect your name, email, and redemption history to deliver and validate your pass. California residents have rights to know, correct, delete, and limit the use of their personal information, and we do not sell or share personal information as defined by the CPRA. 14. Arbitration, governing law, and disputes
These terms are governed by California law without regard to conflict-of-law rules. Any dispute arising out of or relating to a pass or your participation that is not resolved informally within 30 days of written notice shall be resolved by final and binding arbitration administered by JAMS under its Streamlined Arbitration Rules, before a single arbitrator, seated in San Francisco County, California. Judgment on the award may be entered in any court of competent jurisdiction.
Arbitration is on an individual basis only; class, collective, and representative actions are waived to the extent permitted by law. You may bring an individual claim in San Francisco County small claims court instead of arbitration, and nothing here waives any non-waivable right, including rights under the California Private Attorneys General Act. If any provision of these terms is held unenforceable, the remainder stays in full force.
By purchasing a Chestnut Street Circuit pass you acknowledge that you have read, understood, and agreed to these Terms of Sale, including the assumption of risk in sections 6 and 7, the release and section 1542 waiver in sections 9 and 10, and the arbitration agreement in section 14.
